1. Agreement to Terms

By accessing, registering for, or using Sweet Queue ("the Service," "the Platform," or "Sweet Queue"), you agree to be legally bound by these Terms of Service ("Terms") and all policies incorporated herein by reference. If you do not agree to all of these Terms in their entirety, you are not authorized to use the Service and must immediately cease all use.

These Terms apply to all users of the platform, including business owners ("Makers"), their customers, visitors, and any other individuals who access the platform in any capacity. Sweet Queue reserves the right to modify these Terms at any time. Your continued use of the Service constitutes your binding acceptance of any such changes.

You represent and warrant that you are at least 18 years of age, have the legal authority to enter into this agreement, and that all information you provide to Sweet Queue is truthful, accurate, and complete.

2. Description of Service

Sweet Queue is a business management platform designed for home-based and small creative businesses. The Service enables Makers to create a storefront, manage product listings, receive and track orders, and communicate pricing and payment information to their customers.

Sweet Queue is a software platform only. We are not a marketplace, retailer, food producer, or seller of any goods. We do not inspect, verify, certify, endorse, or take any responsibility whatsoever for the products, services, identity, credentials, licensing, food safety compliance, or business practices of any Maker on the platform.

Sweet Queue makes no representations or warranties regarding the quality, safety, legality, or fitness of any product listed or sold by a Maker. All transactions occur solely and exclusively between Makers and their customers. Sweet Queue is not, and shall not be deemed to be, a party to any such transaction.

3. Accounts and Registration

To use Sweet Queue as a Maker, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password confidential and secure
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately at support@sweetqueue.com of any unauthorized use of your account

4. Subscription and Billing

Sweet Queue offers paid subscription plans (monthly and yearly). By subscribing, you agree to the following:

  • Subscription fees are billed at the start of each billing period
  • Yearly plans are billed annually upfront
  • You may cancel your subscription at any time; access continues until the end of the paid period
  • We reserve the right to change pricing with reasonable notice
  • Refunds are not provided for partial subscription periods, except where required by law

5. Acceptable Use

You agree not to use Sweet Queue to:

  • Violate any applicable local, state, or federal laws or regulations
  • Sell illegal, counterfeit, or prohibited goods or services
  • Harass, abuse, or harm other users or customers
  • Misrepresent your identity or business
  • Engage in fraudulent transactions or misleading practices
  • Attempt to reverse-engineer or interfere with the platform
  • Use the platform to facilitate money laundering or other financial crimes
  • Impersonate another person, business, or Sweet Queue itself

Violation of this section may result in immediate suspension or permanent termination of your account without notice or refund.

5.1. Prohibited Products and Services

Makers may not use Sweet Queue to list, promote, or sell any of the following:

  • Cannabis or cannabis-derived products containing THC, including edibles or infused foods, unless explicitly authorized by applicable law and pre-approved by Sweet Queue in writing
  • Any products requiring a government-issued license to sell where the Maker does not hold such a valid, current license
  • Alcohol, tobacco, or controlled substances
  • Hazardous, unsafe, or regulated food products that do not comply with applicable local, state, or federal health and safety laws
  • Products that infringe upon any third party's intellectual property, trademark, or copyright
  • Any item that violates local, state, or federal law
  • Products that are misrepresented in description, ingredients, or origin

Sweet Queue reserves the right to remove any listing, cancel any order, and suspend or permanently ban any account at its sole and absolute discretion if it believes a product or activity violates these restrictions or any applicable law — without prior notice and without liability to the Maker.

5.2. Maker Responsibilities and Legal Compliance

Makers are solely and exclusively responsible for ensuring that all products listed and sold through Sweet Queue comply with all applicable laws and regulations. This includes, but is not limited to:

  • Obtaining and maintaining all required business licenses, cottage food permits, health department certifications, and any other required government approvals prior to listing or selling any product
  • Complying with all applicable food safety, labeling, allergen disclosure, and packaging laws in their jurisdiction
  • Accurately representing all ingredients, allergens, and product contents
  • Properly handling, storing, and delivering products in accordance with all applicable health and safety standards
  • Collecting and remitting all applicable taxes on their sales
  • Maintaining adequate insurance coverage for their business activities where required or advisable

Sweet Queue does not verify, endorse, or take responsibility for the legality, safety, quality, or accuracy of any product listed by a Maker. By using this platform, Makers represent and warrant that they are operating legally and in full compliance with all applicable laws.

Makers agree to indemnify, defend, and hold harmless Sweet Queue, its owners, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) any product listed or sold through Sweet Queue; (b) the Maker's failure to comply with applicable laws or regulations; (c) any customer dispute, injury, illness, or complaint related to the Maker's products; or (d) any violation of these Terms.

6. Orders and Payments

Sweet Queue facilitates order management between Makers and their customers but is not a party to any transaction between them. All payments are handled directly between Makers and customers via their chosen payment methods (Venmo, Zelle, CashApp, etc.). Sweet Queue is not responsible for any disputes, chargebacks, refunds, or issues arising from these transactions.

Sweet Queue reserves the right to monitor, review, and remove listings or transactions that may violate applicable laws or these Terms, at any time and without notice.

Makers are solely responsible for honoring their orders, issuing refunds where applicable, and resolving disputes with their customers. Sweet Queue shall have no obligation to mediate or resolve any dispute between a Maker and a customer.

7. Content and Intellectual Property

You retain ownership of all content you upload to Sweet Queue (product photos, descriptions, etc.). By uploading content, you grant Sweet Queue a non-exclusive, royalty-free, worldwide, perpetual license to display, reproduce, and use your content solely for operating and promoting the Service.

You represent and warrant that you own or have the legal right to use all content you upload, and that such content does not violate the intellectual property rights, privacy rights, or any other rights of any third party. Sweet Queue reserves the right to remove any content at any time, with or without notice, that it determines in its sole discretion to be in violation of these Terms or applicable law.

Sweet Queue's branding, design, code, features, and all related intellectual property are exclusively owned by Sweet Queue and may not be copied, reproduced, distributed, or used in any form without express written permission.

7.1. Reporting Violations

If you become aware of any Maker or user violating these Terms, including but not limited to selling prohibited products, engaging in illegal activity, or misrepresenting their business, you are encouraged to report it immediately to support@sweetqueue.com.

Sweet Queue will investigate reports at its sole discretion and may take any action it deems appropriate, including removal of content, suspension, or termination of accounts, and reporting to law enforcement authorities.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Sweet Queue, its owners, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind, including but not limited to loss of profits, loss of data, personal injury, property damage, or any damages resulting from the sale, consumption, or use of any product listed through the platform.

Sweet Queue is not liable for any harm, illness, injury, allergic reaction, or death caused by any product sold by a Maker on this platform. Our total liability to you for any claim arising from your use of the Service shall not exceed the total subscription fees you paid us in the 12 months immediately preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

9. Termination and Account Suspension

Sweet Queue reserves the right to suspend, restrict, or permanently terminate your account at any time, with or without notice, and for any reason, including but not limited to:

  • Violation of any provision of these Terms
  • Listing or selling prohibited products or services
  • Suspected fraudulent, illegal, or harmful activity
  • Complaints from customers or third parties
  • Non-payment of subscription fees
  • Any conduct Sweet Queue determines, in its sole discretion, to be harmful to the platform or its users

Termination or suspension shall not entitle you to any refund of subscription fees. Upon termination, your storefront will be immediately deactivated and your data may be deleted after a reasonable retention period.

You may terminate your account at any time by contacting us at support@sweetqueue.com or cancelling your subscription.

10. Disclaimers

Sweet Queue is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee uninterrupted, error-free, or secure operation of the Service and are not responsible for losses resulting from service outages, data loss, or technical issues.

Sweet Queue does not endorse, verify, or guarantee any Maker, product, or transaction on the platform. Any reliance on information provided by Makers is at your own risk.

10.1. Indemnification

You agree to indemnify, defend, and hold harmless Sweet Queue and its affiliates, officers, directors, employees, contractors, licensors, and agents from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) any product you list, promote, or sell through the platform; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; (e) any third-party claim related to your business, products, or conduct; or (f) any customer harm, illness, or injury related to your products.

10.2. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You hereby consent to the exclusive personal jurisdiction of the state and federal courts located in California for resolution of any dispute not subject to arbitration.

10.3. Mandatory Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Except for claims that qualify for small claims court, you and Sweet Queue agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in California.

CLASS ACTION WAIVER: YOU AND SWEET QUEUE EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY. YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL.

If any part of this arbitration provision is found unenforceable, the remaining portions shall remain in full force and effect.

10.4. Cooperation with Law Enforcement

Sweet Queue will fully cooperate with law enforcement agencies, regulatory bodies, and government authorities in any investigation involving the use of our platform for illegal activity. Sweet Queue reserves the right to disclose any Maker's account information, listings, order history, and any other relevant data to law enforcement without notice to the Maker when required by law or when Sweet Queue believes in good faith that disclosure is necessary to prevent harm or illegal activity.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes by email or a notice within the platform. Continued use of the Service after changes constitutes acceptance of the updated Terms.
